MORE THAN ONE MARRIAGE, CHILDREN FROM ONE OR MORE MARRIAGES

Question: 

I have recently got remarried. I have two children from a previous marriage. They are still under 18 yrs and are living with their mother. I pay maintenance for them. I also have one child with my new wife. When I divorced from my first wife, I made a new Will leaving everything to my two kids. I want to make a new Will to take care of this new child. What kind of arrangements should I make? 

Answer: 

When you are in a situation where you have been married more than once, and you have children from both marriages, the Will is non standard, and you need to talk with a Solicitor to get a Will done that looks after all parties (we offer a full service Will on this site). Some general pointers for you to consider:

  • You need to do a new Will, because your second marriage has invalidated your Will

  • You new Will needs to take care of all of your dependants, that is, your children from the first marriage, and your second wife and child from your second marriage

  • If you think that your assets are inadequate to provide for all of these dependents, then consider taking out Life/disability/mortgage insurance
