SEPARATION

Question: 

I recently separated from my husband. I don’t think we’ll reconcile. We made Wills a few years ago leaving everything to each other. Is my Will still in force, or has it been invalidated due to my separation?

Answer: 

Your Will is not invalidated by your separation, so if you were to pass away before a divorce formalised your separated state, your Will made during your marriage would take force and your husband would receive your entire estate.

If you would not be happy with this situation, you can change your Will now.  If you reconcile you can always change your Will again to reflect your new circumstances.
